Michael Radant, the 37-year-old co-owner of a downtown Chelsea eatery charged with two counts of third-degree criminal sexual misconduct, had his case bound over to circuit court after a preliminary examination in the 14A-1 District Court Tuesday, his attorney Michael Montoye said.
The 37-year-old woman who made the allegations was the only person to testify at the exam, Montoye said. Judge Richard Conlin found there was probable cause that a crime occurred and that Radant was responsible and bound the case over to the higher court.
A pretrial hearing date was set for Jan. 10 in Judge David Swartz's courtroom, according to court records.
"The case is proceeding along," Montoye said.
He had no additional comment about the matter.
The 37-year-old woman told police Radant sexually assaulted her at a residence in the 700 block of North Main Street on Nov. 15. The two were acquainted for some time, police said. The woman came into the Chelsea Police Department to report the incident on Friday.
Police did not go into much detail about the incident. Third-degree criminal sexual conduct involves both force and penetration, Toth said.
Radant is the co-owner of Ellie’s Chelsea, a burger and sandwich shop located at 312 N. Main St. in the Clocktower Commons in Chelsea.
